Terms of Service
1. Introduction
This Terms of Acceptable
Use Policy ("AUP" or "Policy") is designed to keep MacConnect and the Internet
enjoyable and useful for all of our members. Violation of this Policy may
result in suspension or cancellation of MacConnect services.
MacConnect is committed
to and supports the free flow of information and ideas over the Internet.
MacConnect does not actively monitor nor does MacConnect exercise editorial
control over the content of any web site, electronic mail transmission,
mailing list, news group or other material created or accessible over MacConnect
services. However, MacConnect reserves the right to remove any materials
MacConnect does become aware of that are, in MacConnect's sole discretion,
potentially illegal, could subject MacConnect to liability, or violate
this Policy.
2. Policies
The following are
violations of MacConnect policies:
2.1. Using
a personal account for high volume or commercial use. If you would like
to provide high-volume or commercial services, please contact MacConnect
Sales for information about opening up a commercial account. Activities
which are prohibited as high volume include, but are not limited to:
- Exceeding 5MB of disk space
for your email box. Any email box exceeding 5MB will have incoming mail
bounced until the user removes a sufficient number of messages as to
return to compliance with this Policy.
- Exceeding 5MB of disk space
for personal web sites. Any personal web site exceeding 5MB will be suspended,
until the customer brings the disk usage under 5MB as measured on MacConnect
drives.
- Exceeding 1GB of traffic in
a one month period for personal web sites. Personal web sites exceeding
1GB of traffic in a one month period will be suspended until alternate
arrangements for serving such sites can be made.
- Regularly sending similar e-mail
messages to more than 50 MacConnect members and/or Internet users in
a "listserver" type fashion.
2.2. Using
MacConnect services for illegal purposes, or in support of illegal activities.
MacConnect reserves the right to cooperate with legal authorities and/or
injured third parties in the investigation of any suspected crime or civil
wrong. Activities which are prohibited as potentially illegal include,
but are not limited to:
- Unauthorized copying of copyrighted
material including, but not limited to, digitization and distribution
of photographs from magazines, books, or other copyrighted sources, and
copyrighted software.
- Exporting software or technical
information in violation of U.S. export control laws.
- Posting or emailing of scams
such as 'make-money-fast' schemes or 'pyramid/chain' letters.
- Threatening bodily harm or
property damage to individuals or groups.
- Making fraudulent offers of
products, items, or services originating from your account.
- Attempting to access the accounts
of others, or attempting to penetrate beyond security measures of our
or other systems (referred to as hacking) whether or not the intrusion
results in corruption or loss of data.
2.3.
Harassing others by 'mail-bombing' or 'news-bombing'. 'Mail-bombing' constitutes
sending more than ten (10) similar mail messages to the same email address.
'News bombing' constitutes sending more than 10Mbytes of data to a newsgroup.
2.4. Revealing
your account password to others or allowing use of your account by others
(other than authorized users in your household). At no time can there be
simultaneous use of the same user name and password combination.
2.5. Forging
any message header, in part or whole, of any electronic transmission, originating
or passing through MacConnect services.
2.6. Distributing
viruses to or from MacConnect systems.
2.7. Use
of software or any device that would allow your account to stay logged
on while you are not actively using MacConnect services.
2.7a. Operation
of server software of any type (including, but not limited to, mail servers,
web servers, FTP servers, news servers, game servers, chat servers, Hotline
servers and AppleShare IP servers) on computers connected to our network
via analog dial-up, digital dial-up or ISDN. The use of "connection sharing"
packages such as IPNetRouter or Vicom Internet Gateway is permitted, however
the running of server software on gateway machines or machines connected
"downstream" of a gateway machine is prohibited.
2.8. Cross-posting
advertisements for products, items, or services to ten (10) or more unrelated
USENET newsgroups.
2.9. Posting
articles to any USENET or other news group, mailing list or similar forum
which are off-topic according to the charter or other public statement
of the forum.
2.10. Disrupting
any newsgroup with frivolous, excessively vulgar, or repetitious postings.
2.11. Posting
of binary, or excessively large, unrelated text files to non-binary news
groups that have specifically requested such material not be posted in
the group's FAQ (Frequently Asked Questions).
2.12. Installation
of 'auto-responders', 'cancel-bots' or similar automated or manual routines
which generate excessive amounts of net traffic, or disrupt net newsgroups
or email use by others.
2.13. Engaging
in any of the above activities using the service of another provider but
channeling such activities through an MacConnect account or re-mailer,
or using an MacConnect account as a mail drop for responses.
2.14 Using
MacConnect mailservers to distribute "spam" or unsolicited e-mail advertisements,
announcements, offers, etc. to MacConnect members and/or other Internet
users.
3. MacConnect
Assumes No Liability
MacConnect has no
practical ability to restrict all conduct, communications or content which
might violate this Policy prior to transmission on MacConnect, nor can
MacConnect ensure prompt removal of any such communications or content
after transmission or posting. Accordingly, MacConnect does not assume
liability to subscribers or others for any failure to enforce the terms
of this Policy.
4. Revisions
to this Policy
MacConnect reserves
the right to modify this Policy at any time upon at least thirty (30) days
prior notice. Notice of modifications to this Policy may be given to subscribers
by posting such changes to the MacConnect web site (http://www.macconnect.com),
by electronic mail, or by conventional mail.
